Privacy Policy and Principles

The operator of www.malagarden.hu hereby informs the visitors of the Website (hereinafter referred to as “the Website”) on the data processing practices followed, the organisational and technical measures taken regarding data protection, as well as the relevant visitor rights and the assertion of such rights.

In case the Operator requires personal data from the visitor of the Website (hereinafter referred to as “User”) for any purpose, the following provisions apply.

Present Privacy Policy contains the fundamental information relevant to the management, processing and recording of any personal data provided by the User upon using the Website of the Operator. Should you have any questions regarding the processing of your personal data, please contact our Customer Services prior to using the Website.

The Privacy Policy is subject to change any time, the User is required to review the Website from time to time to ensure they are aware of any possible modifications. The Privacy Policy came into force on 1st March 2010. The Operator is responsible for processing your personal data provided through the Website.

Data request, data protection

Although Users are generally not required to provide any data to use the Website, you may need to provide specific personal data to the Operator in order to use certain services.

Depending on the service, the Operator may require the following personal data:

  • your name and contact details, including your email address, home address and company details;
  • information about your personal and professional interests;
  • demographic details;
  • your experience related to our products and preferences regarding the use of your contact details so that we can provide you with additional information about our products and services.

1. The range of processed data

The start and end time of the User’s visit to the Website is automatically recorded, and in certain cases – depending on the settings of the User’s computer – the type of browser and operational system used. Such data is automatically transformed into statistical data. The Operator shall not link such data to personal data. Upon login, the Website sends a session ID, which is automatically deleted upon leaving the Website.

Processing the data provided for the use of the Website is based on the voluntary consent of the User.

The Operator requests that “Minors” – as determined by the relevant local regulations – not carry out legal transactions (purchases or any other transactions) without the consent of a parent or legal guardian.

2. The purpose of data processing

The purpose of data processing is to provide permanent contact between the registered Users using the services of the Website and the Operator, as well as to survey public opinion. In addition, it uses and processes the data solely for the purpose of maintaining a higher quality service for the User, especially in the following areas:

  • to answer the User’s questions asked through the Website;
  • to deliver newsletters;
  • to keep internal records;
  • to enhance Website content;
  • to provide information on Website updates;
  • to customise Website content;
  • to deliver publications ordered by the User on the Website.

The Operator may contact the User via email, phone, fax or mail, unless the User has marked one of these options as a preference.

The time of visit and the type of browser and operational system are registered and stored for statistical purposes only.

The Operator shall not use personal data for purposes other than the purposes listed herein. Processing the data provided in this form is based on the voluntary consent of the User.

All personal data and facts about the User shall be handled confidentially by the Operator and shall be used exclusively for the purposes of improving its services, selling advertisement slots, carrying out internal research and producing statistics. Reports based on such statistics shall be published in a format that does not contain personally identifiable information about the Users.

The Operator shall not transfer, disclose, sell, rent or make your personal data accessible to third parties without your consent, unless it is necessary for the purposes described herein, or required by law.

In case the Operator wishes to inform the User about products and opportunities that the User may be interested in, it will provide such information by mail, phone, fax or email, unless the User has marked one of these options as a preference.

Upon providing their personal data, the User may indicate to the Operator if they do not consent to the processing of their data for direct marketing purposes. In case the User chooses this option, the Operator shall not contact them for direct marketing purposes. In this case, please contact our Call Centre. In case the User is the Operator’s client, or the User has requested information on the Operator’s products, the Operator may send information on their range of products via email, unless they are explicitly asked not to do so.

3. Duration of data processing

Session IDs are automatically deleted upon leaving the Website.

The Operator shall not assume responsibility for the deleted pages of the Website that are still accessible through search engine archives. Deletion of such pages is the duty of the search engine’s operator.

4. Access to personal data, data processors

Personal data provided by the User may be accessed by the staff of the Operator.

The Operator shall not transfer personal data to third parties except for those indicated herein. This does not apply to any statutory, mandatory data transfers, which may take place in exceptional cases only. The Operator carefully assesses whether there is a real legal basis for providing data on each request of the authorities prior to performing it.

5. The Users’ rights about the processing of their personal data, data deletion

The legal basis for the data processing is the voluntary consent of the Users.

Users may request information on the processing of their personal data. Upon request, the Operator shall provide information to the party concerned on their data processed by the Operator, the purpose of data processing, its legal basis, duration, the Operator’s name and address (registered office: Siófok Petőfi sétány 15/A) and its activities related to data processing, as well as information on the identity of the persons receiving the data and the purpose of such data transfer. The User may also use the above contact information to initiate the correction or deletion of their personal data.

In the event of inappropriate use of the Website or upon request by the User the User’s data shall be deleted. Deletion shall be performed within 24 hours following the next working day calculated from the reception of the request.

The Operator attaches great importance to the protection of your personal data. To prevent unauthorised access to personal data, we implement adequate physical and electronic procedures for the safeguarding and protection of the data received online.

6. Data protection measures

The Operator stores personal data on the servers of Webshark Kft. (H-9700 Szombathely, Semmelweis Ignác u. 2. – Pelikán Palace Irodaház www.webshark.hu ), which are under 24-hour surveillance by security guards and can be found on the Hungarian Internet backbone network.

7. Legal remedies

The User who feels that the Operator has violated their data protection rights may file a claim before a civil court, or request assistance from the data protection commissioner. The detailed legal regulations related to this and to the obligations of the Operator are included in Act LXIII of 1992 on the Protection of Personal Data and The Publicity of Data of Public Interest.

For the establishment of our privacy policy we have taken as a basis the Act LXIII of 1992 on the Protection of Personal Data and The Publicity of Data of Public Interest; and Act VI of 1998 on The Protection of Individuals with regard to Automatic Processing of Personal Data.

8. Information on dangers threatening privacy

Using the Internet involves various dangers threatening privacy.

Note that your opinion presented at the Website is personal data, from which conclusions may be drawn regarding sensitive data, such as your ethnic origin or political opinions. This data may be accessed by anyone.
